    This study aims to investigate and to analyze the practices in the courts under the family conciliation system and the social situation in which domestic disputes arise in China from the perspective of gender and East Asian comparison, and attempts to give a certain answer to the classical and modern question, what a “family" is. This study, at first, reveals the diversity of the family in the actual conditions of the Chinese society, and the uniformity of the family conception in the family conciliation cases. And then, it became clear that the diversity of the domestic dispute was beyond the imaginations of the existing family conciliation system. From these analyzes, it became clear that the existing family conciliation system had a great influence on the formation of the uniform family conception in China.

    Our examination of current legal principles and interpretations of the family law indicates that the legal system has failed to respond to reality and needs of families, that is to say the “family model" which operates as norms reproduces various forms of gender-based discrimination. Our examination of diverse forms of families and the lack of considering the individual in the family law also suggest the necessity of reducing such normative views that influence the families rather negatively. By revising the roles of the family law, we conclude that they should protect individuals from family violence and provide an appropriate care.

    `Human Rights' and `the Best Interest of the Child' are universal principles and they are embodied by international treaties and domestic laws. However, the process and the present situation could be different in every country. This research aims to find such similarities and differences regarding on parenthood, custody and guardianship in Asian countries, namely the former English colonies: India, Bangladesh, Singapore and Malaysia.
